Professional Activities

Martin is a partner in the firm's Ottawa office and has a wide-ranging commercial and regulatory law practice.  He has significant expertise in the field of international trade law, as well as competition matters, federal regulatory law, procurement review, Federal Court advocacy, aboriginal law, and telecommunications law. A summary of his experience in these areas illustrates the depth of skills he brings to client counsel:

• Trade Law: Mr. Masse's trade law experience focuses on anti-dumping, subsidy and safeguard matters. He has appeared before the Canadian International Trade Tribunal ("CITT") in a number of dumping and subsidy injury inquiries. He has been involved in a number of judicial review proceedings of Final Determinations of Dumping, as well as Findings of Injury, before NAFTA Binational Dispute Resolution Panels and the Federal Court of Appeal.
• Procurement: Mr. Masse has also advised clients in preparing bids and proposals and drafting procurement guidelines. He represents clients in challenges of unfavourable procurement decisions to the CITT and the Federal Court.
• Competition Law: Mr. Masse's experience in competition law extends to all matters covered by the Competition Act.  In particular, Mr. Masse has assisted clients in complying with the Competition Bureau's merger notification regime.  He has also advised clients regarding civil and criminal investigations and has assisted in the implementation of competition compliance programs.
• Federal Regulatory Law: Mr. Masse can assist with a number of federal regulatory law matters, including Investment Canada Act compliance and dealings with Industry Canada and the Canadian Radio-Television and Telecommunications Commission ("CRTC"). Moreover, his experience before the Federal Court allows him to help clients in judicial challenges of decisions of federal agencies.
• Aboriginal Law: Mr. Masse provides advice to several aboriginal groups and to companies considering developments on property subject to land claims.
• Federal Court & Administrative Law Advocacy: Mr. Masse has been involved in a number of judicial review applications in the Federal Court and Federal Court of Appeal. He has represented clients before the Ontario Superior Court, Divisional Court and Court of Appeal, administrative tribunals, and arbitration panels.

• Represents Rogers Communications Inc. and other clients in federal government procurement challenges to the CITT
• Represented a large multi-national telecommunications company in its dealings with Industry Canada
• Acted for Silian Sapphire Corporation, a wholly-owned subsidiary of China Silian Instruments Group Co., Ltd. of Chongqing, China, in the acquisition of the assets of Honeywell International Inc., Honeywell ASCa Inc., and Honeywell Electronic Materials, Inc.
• Acted for Deluxe Vancouver Ltd., a division of the Deluxe Entertainment Services Group Inc., when it acquired Rainmaker Entertainment Inc., a division of Rainmaker Income Fund, along with Visual Effects UK Limited, Rainmaker's visual effects operation in London, England, for approximately C$31 million
• Handled numerous large anti-dumping, subsidy and safeguard cases before the CITT
• Obtained Competition Bureau merger compliance for numerous proposed merger transactions in various industries, such as telecommunications, plumbing and HVAC distribution and paper products
• Assists companies in establishing and maintaining Competition Act compliance programs
• Acted for the Nunavut Wildlife Management Board in a successful Federal Court challenge to a government fishing license decision
• Participated in drafting several comprehensive studies for the Competition Bureau
• Appeared before the Ontario Court of Appeal on behalf of an international logistics and mailing organization
• Represented numerous parties in judicial review applications before the Federal Court and Federal Court of Appeal
• Acted for the Inuvialuit of the Western Arctic in arbitration hearings relating to the implementation of the Inuvialuit Land Agreement
