A. By-law Challenges

  • Assisted with lead counsel in successful defence of jurisdictional and constitutional challenges to the City's Adult Entertainment Parlour By-law before the Ontario Superior Court of Justice. ( The Adult Entertainment Parlours Association of Canada et al. v. City of Ottawa , Hackland, J. May 18, 2006) and Court of Appeal for Ontario (to be heard in January, 2007).

B. Municipal Assessment & Taxation

  • Assisted with lead counsel in successful defence of jurisdictional challenge to capping, claw back and related taxation provisions under the Municipal Act and related City by-laws before the Ontario Superior Court of Justice. ( Bettencourt v. City of Ottawa , Power, J., September 14, 2005).
  • Assisted with lead counsel in ongoing litigation involving municipal taxation legislation before the Ontario Superior Court of Justice. ( Rostrust Investments Inc., et al. v. City of Ottawa et al ., OSCJ File No. 03-CV-26260).

C. Civil & Commercial Litigation

  • Assisted with lead counsel in previous and ongoing proceedings against the City and other parties respecting Tripartite Agreement before the Ontario Superior Court of Justice. ( School of Dance v. City of Ottawa , 2004 - 2006).
  • Assisted with lead counsel in successful settlement at arbitration of contractual dispute involving the City and a tenant. ( The Coliseum Inc. v. City of Ottawa , 2006).
City of Greater Sudbury
  • Assisted with opinion work to the City of Greater Sudbury in 2006 respecting capping, claw back and related taxation provisions under the Municipal Act and related City by-laws.
