Professional Experience
Robert Wisner is a partner in the Litigation group of McMillan. His practice focuses on international commercial arbitration, cross-border litigation, investment treaty arbitration and international trade.
Robert has been recognized for his work in international arbitration in a number of legal directories, including Chambers Global, Who's Who Legal, Best Lawyers in Canada, Lexpert and Legal Media Group's Guide to the World's Leading Experts in Commercial Arbitration.
Robert has argued cases involving businesses and governments from around the world before international arbitral tribunals established under international commercial contracts, bilateral investment treaties and trade agreements. Robert has also appeared at the trial and appellate levels of the Ontario and Federal courts in international, corporate-commercial and competition litigation. His international trade and competition law experience has included representing clients before federal government departments and agencies.
In addition to his advocacy work, Robert provides advice to international businesses on foreign investment protection, political risk insurance, anti-bribery and other international treaty issues. Many of his clients are natural resources companies operating in emerging markets. Prior to practicing law, Robert served as an economist in the Investment Policy Division of Canada's Department of International Trade.
Representative Transactions
- Counsel in ICSID, UNCITRAL and NAFTA investment treaty arbitrations against states in North and South America, Eastern Europe and Central Asia arising out of the mining, energy, forestry, steel, financial services, transportation, and airport services sectors.
- Counsel in ICC, SCC, CIETAC, KLRAC and MNAC commercial arbitrations and related litigation involving parties in Canada, Western Europe, Asia and Africa. Disputes have arisen under joint venture and license transfer agreements in the mining sector, long term supply agreements for petrochemicals, power plant construction contracts and international sales contracts.
- Appearing before the Ontario Superior Court and Federal Court of Canada in disputes relating to international arbitrations, foreign litigation and general corporate-commercial matters.
- Advised clients on foreign investment protection, anti-bribery, extraterritorial legislation and OECD, NAFTA, Energy Charter Treaty and WTO provisions relating to mining, electricity, oil & gas, agriculture, postal services and government procurement.
- Counsel to complainants and respondents before the Canadian Competition Bureau and in related litigation involving distribution and pricing practices.
